These terms govern your use of atlastransportexpress.com and the booking of freight, warehousing, and logistics services with Atlas Transport Express.
These Terms of Use ("Terms") govern your access to and use of atlastransportexpress.com (the "Site") and the freight, warehousing, and logistics services (the "Services") provided by Atlas Transport Express ("Atlas," "we," "us," or "our"). By accessing the Site, requesting a quote, or booking a shipment, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
By using the Site or Services, you confirm that you have the authority to enter into these Terms on behalf of yourself or the company you represent. Additional terms may apply to specific services — such as a signed rate confirmation, bill of lading, or warehousing agreement — and where a conflict exists, the terms of that specific agreement will govern for that transaction.
Our Services are intended for business use by shippers, brokers, and their authorized representatives. If we provide you with a dispatch portal or tracking account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@atlastransportexpress.com if you suspect unauthorized use.
Requesting a quote through the Site does not guarantee capacity or a final rate. A booking is confirmed only once a rate and pickup window have been accepted by both parties, typically through a rate confirmation or equivalent written agreement. You are responsible for providing accurate shipment details, including weight, dimensions, commodity type, and any special handling requirements — inaccurate information may result in delays, additional charges, or refusal of the load.
Rates quoted through the Site are estimates and may be adjusted based on final weight, dimensions, accessorial services, or changes to the shipment after booking. Invoices are due according to the payment terms agreed at booking. Late payments may be subject to holds on future shipments, storage or detention charges, and interest as permitted by law.
You agree not to tender freight that is illegal to transport, undeclared hazardous material, or otherwise prohibited by federal or state law, without prior written agreement and proper documentation. You also agree not to:
Our liability for loss or damage to freight is governed by the applicable bill of lading, carrier liability terms, and, where applicable, the Carmack Amendment or comparable state law. Claims for loss, damage, or delay must be submitted in writing within the timeframe specified on your bill of lading or service agreement, along with supporting documentation.
Except as required by law or a signed service agreement, Atlas Transport Express is not liable for indirect, incidental, or consequential damages, including lost profits or business interruption, arising from delayed or undelivered freight.
The Site and any information on it — including tracking status, transit estimates, and service descriptions — are provided "as is" without warranties of any kind, express or implied. While we work to keep tracking data accurate and current, GPS and milestone updates may be delayed or interrupted by factors outside our control, including weather, mechanical issues, or connectivity gaps.
The Site, including its design, text, graphics, logos, and underlying code, is owned by Atlas Transport Express or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written consent.
The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, accuracy, or practices of those third parties, and linking to them does not imply endorsement.
We may suspend or terminate your access to the Site or an account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or created risk or legal exposure for Atlas Transport Express. Provisions that by their nature should survive termination — including liability limitations and intellectual property rights — will continue to apply.
These Terms are governed by the laws of the United States and the state in which Atlas Transport Express is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in that state, unless otherwise required by applicable federal transportation law.
We may update these Terms from time to time to reflect changes in our services or legal requirements. We will post the revised Terms on this page with an updated effective date. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
Questions about these Terms of Use can be directed to our team.
